Terms & Conditions

These Studio Terms and Conditions (“Terms”) govern your purchase of memberships, class packages, private instruction, workshops, and other services offered by Formacore Pilates, LLC (“Formacore,” “we,” “us,” or “our”). By purchasing or registering for any Service, you acknowledge that you have read, understand, and agree to be bound by these Terms. 

These Terms are intended to establish the general terms governing your relationship with Formacore. Participation in classes and other studio activities also requires acceptance of Formacore’s Liability Waiver and Release. Formacore’s collection, use, and protection of personal information is governed by its Privacy Policy. Together, these documents constitute the agreement between Formacore and its clients regarding studio services.

STUDIO SERVICES AND PARTICIPATION

  • STUDIO SERVICES.  Formacore offers Pilates instruction, fitness classes, private training sessions, workshops, memberships, class packages, retail merchandise, and related wellness services (“Services”). Services, memberships, pricing, schedules, and instructors are subject to availability and may be modified or discontinued upon reasonable notice.

    Nothing in these Terms guarantees the availability of a particular instructor, class format, schedule, or location.  By registering for classes, purchasing a membership or service, or otherwise participating in Formacore’s programs, you agree to comply with these Terms and all reasonable studio policies communicated by Formacore.

  • MEMBERSHIP AND PACKAGES. Formacore offers recurring memberships, class packages, introductory offers, private sessions, workshops, and other Services as published on its website or booking platform. The fees, duration, benefits, eligibility requirements, and other terms applicable to each membership or Service are those in effect at the time of purchase unless otherwise agreed in writing. 

  • STUDIO POLICIES.  Clients agree to comply with these Terms and with Formacore’s reasonable studio policies, safety requirements, and operating procedures, including policies governing reservations, waitlists, cancellations, attendance, use of equipment, and studio conduct. Formacore may modify these policies from time to time upon reasonable notice.

  • RELATED AGREEMENTS.  Participation in Formacore’s Services requires acceptance of Formacore’s Liability Waiver and Release. Formacore’s collection, use, and protection of personal information is governed by its Privacy Policy.


MEMBERSHIP, FEES, AND PAYMENT

  • MEMBERSHIPS AND SERVICES. Formacore offers recurring memberships, introductory offers, class packages, private instruction, workshops, and other Services. The fees, duration, benefits, and other terms applicable to each membership or Service are those published by Formacore at the time of purchase and may be modified prospectively upon reasonable notice. Unlimited monthly memberships include one (1) class per day. Additional classes attended on the same day may be charged at Formacore’s then-current additional class rate.

  • FEES AND PAYMENT. Payment is due at the time of purchase unless otherwise agreed by Formacore. Formacore accepts payment by credit card, debit card, or other payment methods approved by Formacore.  Recurring memberships automatically renew at the end of the applicable membership term unless cancelled in accordance with these Terms. By purchasing a recurring membership, Client authorizes Formacore to charge the payment method on file for recurring membership fees and any applicable late cancellation or no-show charges authorized by these Terms.  Client is responsible for maintaining current payment information.

  • MEMBERSHIP CHANGES AND FREEZES. Recurring memberships may be cancelled after any required initial membership commitment has been satisfied by providing Formacore at least ten (10) days' advance notice before the next scheduled payment date. 

    Memberships may be temporarily frozen for suspensions exceeding ten (10) consecutive days by providing Formacore at least seven (7) days’ advance notice before the requested suspension date. If a recurring membership is canceled before completion of the required initial membership commitment, Client remains responsible for any applicable early cancellation charges or pricing adjustments. 

  • MEMBERSHIP FEE CHANGES, REFUNDS AND TRANSFERS. Except as otherwise required by law, all membership fees, class packages, and Services are non-refundable. Unused class credits or memberships may not be redeemed for cash. Unless otherwise prohibited for a particular promotion or package, Formacore may permit unused class packages to be transferred to another client upon request and subject to Formacore’s approval.

    Memberships, class packages, promotional offers, and other Services are subject to any additional terms and conditions applicable to the specific membership, package, promotion, or Service purchased by the Client.

  • If there is any inconsistency between these Terms and the description of a specific membership, package, promotion, or Service published by Formacore at the time of purchase, the published description of that membership, package, promotion, or Service shall control to the extent of the inconsistency. 


CLASS RESERVATIONS, ATTENDANCE, AND CANCELLATIONS

  • CLASS RESERVATIONS.  Advance registration may be required for classes, private sessions, workshops, or other Services. Reservations are subject to instructor availability, class capacity, and scheduling considerations. Formacore reserves the right to modify class schedules, substitute instructors, cancel classes, or limit enrollment as reasonably necessary for the operation of the Studio.

  • CLASS ARRIVAL. Clients are encouraged to arrive sufficiently before the scheduled class time to prepare for class and receive any necessary instruction. The Studio generally opens fifteen (15) minutes before each scheduled class. Clients attending their first class should arrive at least ten (10) minutes before the scheduled class time to receive an orientation regarding the safe use of Formacore’s equipment. Clients arriving after the scheduled start time may be denied entry if late arrival would disrupt the class or compromise safety. Grip socks are required during all classes and may be purchased at the Studio.

  • CANCELLATIONS AND NO-SHOWS.  Because class sizes are limited, Formacore maintains cancellation and attendance policies designed to provide all clients with a fair opportunity to reserve available class space. Classes canceled at least six (6) hours before the scheduled start time will be returned to the Client's account for future use, if applicable.

    Late cancellations, no-shows, forfeiture of class credits, and applicable fees shall be governed by Formacore’s cancellation policies in effect at the time of the reservation. Clients enrolled in recurring memberships authorize Formacore to charge the payment method on file for applicable late cancellation or no-show fees.  Emergency cancellation requests may be considered on a case-by-case basis; however, Formacore reserves the right to enforce its cancellation policies.

  • WAITLISTS.  Clients may join a waitlist for a full class if they have an available class credit or an eligible membership.  If space becomes available, Formacore may automatically enroll Clients from the waitlist and notify them using the contact information associated with their account. Clients are responsible for maintaining current contact information and notification preferences. Clients may remove themselves from a waitlist in accordance with Formacore’s published waitlist procedures. Clients who are moved from the waitlist into a class remain subject to Formacore’s cancellation and no-show policies.

  • STUDIO CLOSURES AND SCHEDULE CHANGES. Formacore may temporarily close the studio, modify class schedules, substitute instructors, or suspend Services because of holidays, maintenance, weather, emergencies, instructor availability, public health concerns, or other circumstances reasonably beyond Formacore’s control. Formacore will make reasonable efforts to notify affected Clients of significant schedule changes.


STUDIO POLICIES AND CLIENT RESPONSIBILITIES

  • COMPLIANCE WITH STUDIO POLICIES.  Clients agree to comply with these Terms and with Formacore’s reasonable studio policies, procedures, and safety requirements, as they may be adopted or modified from time to time. These policies are intended to promote the safety, comfort, and enjoyment of all clients and the efficient operation of the Studio.

  • HEALTH AND SAFETY.  Clients agree to exercise reasonable care while participating in the Services and to follow the instructions of Formacore’s instructors and staff regarding the safe use of studio equipment and participation in classes or other activities.  Clients should not participate in any Service if they reasonably believe doing so may present a health or safety risk to themselves or others. Clients are encouraged to advise instructors of any injury, medical condition, or physical limitation that may affect their participation.

  • RESPECTFUL CONDUCT. Clients agree to conduct themselves in a courteous and respectful manner toward Formacore’s instructors, staff, clients, guests, and visitors. Conduct that is disruptive, abusive, threatening, harassing, unsafe, or otherwise interferes with the operation of the studio may result in the suspension or termination of Services or membership privileges without refund, to the extent permitted by law.

  • PHOTOGRAPHY AND PROMOTIONAL MEDIA.  From time to time, Formacore may photograph or record classes, events, or other studio activities for promotional or marketing purposes. Formacore will make reasonable efforts to notify clients in advance whenever photography or recording is taking place. By participating in a class or event after such notice has been provided, Client grants Formacore permission to use Client's image, likeness, and voice in photographs, videos, or other media for promotional, advertising, and marketing purposes without additional compensation. Clients who prefer not to appear in photographs or recordings should notify a member of Formacore’s staff before the class or event, and Formacore will make reasonable efforts to accommodate that request.

  • COMMUNICATIONS. By purchasing a membership or Service, Client agrees that Formacore may communicate with Client by email, telephone, text message, or other reasonable means regarding class reservations, schedule changes, billing matters, studio announcements, safety notifications, and other matters related to Client's membership or participation. Clients may opt out of non-essential marketing communications at any time; however, Formacore may continue to send transactional, scheduling, billing, or safety-related communications as reasonably necessary to provide its Services. 

  • By booking or purchasing with Formacore, you agree that we may contact you via email, text message, or phone for purposes including, but not limited to: Class confirmations or schedule changes, late arrival or no-show follow-ups, emergency notifications, checking in if you have not arrived for a scheduled class.

  • You may opt out of non-essential marketing communications at any time, but transactional and safety-related messages may still be sent.

Mobile Program Description

  • By opting in, you agree to receive recurring automated text messages from Formacore ("we," "us," "our") at the mobile number you provided. Messages may include [appointment reminders, order updates, account alerts, promotional offers, customer support follow-ups, etc.. Consent to receive these messages is not a condition of any purchase.

Message Frequency

  • You may receive up to 4 messages per month. Message frequency may vary depending on your activity and interactions with us.

Message and Data Rates

  • Message and data rates may apply. Charges are billed by and payable to your mobile service provider. Please contact your wireless carrier for details about your messaging plan.

How to Opt Out and Get Help

  • You can unsubscribe the SMS service at any time by replying STOP to any message we send you. After you send STOP, you will receive a one-time confirmation message, and no further messages will be sent. If you want to rejoin, you can sign up again using the original opt-in method or reply START. For help or more information at any time, reply HELP to any of our messages. Carrier Liability Disclaimer

  • Carriers are not liable for any delayed or undelivered messages.

  • THIRD-PARTY SERVICES. Formacore may utilize third-party service providers, including payment processors, scheduling platforms, communication services, and other vendors, in connection with the operation of the studio. Although Formacore selects these providers in good faith, Formacore is not responsible for their independent services, security practices, or privacy policies.

  • PERSONAL PROPERTY. Clients are responsible for personal belongings brought to the studio. Formacore is not responsible for the loss, theft, or damage of personal property except as otherwise required by applicable law.

GENERAL PROVISIONS

  • ENTIRE AGREEMENT.  These Studio Terms and Conditions, together with Formacore’s Liability Waiver and Release, Privacy Policy, and any membership-specific or service-specific terms published by Formacore at the time of purchase or registration, constitute the entire agreement between Formacore and Client regarding the Services and supersede all prior oral or written discussions, representations, or understandings relating to the subject matter of these Terms.

  • MODIFICATIONS. Formacore reserves the right to modify these Studio Terms and Conditions from time to time upon reasonable notice. Any modification will apply prospectively and will not affect Services previously purchased unless otherwise permitted by law or expressly stated in these Terms. Client's continued purchase or use of Formacore’s Services after the effective date of any modification constitutes acceptance of the revised Terms.

  • GOVERNING LAW AND VENUE. These Studio Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Iowa, without regard to its conflict of laws principles. Any legal action arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Johnson County, Iowa, unless otherwise required by applicable law.

  • SEVERABILITY.  If any provision of these Studio Terms and Conditions is determined to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect, and the invalid, illegal, or unenforceable provision shall be enforced to the fullest extent permitted by law consistent with the intent of these Terms.


ELECTRONIC ACCEPTANCE. By purchasing a membership, class package, private session, workshop, or other Service through Formacore’s website, booking platform, or studio, Client acknowledges that Client has read, understands, and agrees to be bound by these Studio Terms and Conditions.

If Client is under eighteen (18) years of age, the parent or legal guardian accepting these Studio Terms and Conditions represents that he or she has authority to do so on the Client's behalf and agrees to be bound by these Terms to the extent applicable. 

Electronic acceptance of these Studio Terms and Conditions, whether by checking an acceptance box, clicking an “I Agree” button, completing an online purchase or registration, or using another method of electronic assent approved by Formacore, shall have the same force and effect as a handwritten signature.
